Frequently Asked Questions

Common Legal Questions
Answered by UAE Licensed Lawyers

Practical answers to the most common legal questions from expats and businesses in Dubai and the UAE — covering employment, property, family, business and visa law.

All Questions Employment Property Family Law Business Visa & Residency Crypto & Fintech
No. Under UAE Labour Law your employer must settle all outstanding dues including unpaid salary, notice period pay and end-of-service gratuity before cancelling your visa. Visa cancellation without settling dues violates UAE law. You can file an immediate complaint with MOHRE or contact an employment lawyer in Dubai to protect your rights and recover everything you are owed.
Yes, strongly recommended. Without a registered UAE will, Sharia law governs your UAE estate regardless of your religion or nationality. Your bank accounts may be frozen, your property may not pass to your spouse and your children's guardianship may be decided by a UAE court. A DIFC Will for non-Muslim expats resolves all of this and can be registered in 2 to 4 weeks.
The first step is sending a formal legal demand letter from a UAE lawyer. This resolves most debt recovery cases as it signals serious legal intent. If unpaid, we file a court claim in the relevant UAE court. Debt recovery typically takes 2 to 6 months for a court judgment. We also obtain urgent asset freezing orders and travel bans where appropriate to protect your position.
Yes. Expats can purchase freehold property in over 40 designated freehold zones across Dubai including Dubai Marina, Downtown Dubai, Palm Jumeirah, JBR and Business Bay. We strongly recommend having a property lawyer review your Sale and Purchase Agreement before signing to identify risks, unfair clauses and protect your investment fully.
Under 2023 UAE Personal Status Law reforms, non-Muslim expats can apply their home country law for divorce proceedings in UAE courts. Muslim expats follow Sharia-based Personal Status Law. Key issues include child custody, alimony, matrimonial asset division and guardianship. We represent Muslim and non-Muslim expat clients in all UAE family court proceedings with sensitivity and discretion.
VARA is the Virtual Assets Regulatory Authority — the world's first dedicated crypto regulator, established in Dubai in 2022. Any business providing virtual asset services in Dubai including exchanges, brokers, custodians, investment managers and advisors must obtain a VARA licence. Operating without one is illegal and carries significant penalties. We guide businesses through the full VARA licensing process from assessment to approval.
No. Rent increases in Dubai are governed strictly by the RERA Rental Index. Landlords can only increase rent if the current rent is below market value as shown by the Index. The maximum increase is capped at up to 20% if rent is more than 40% below market, and no increase is permitted if rent is at market value. Landlords must give 90 days written notice. We challenge unlawful rent increases through the Rental Dispute Center.
Yes. Following the landmark 2021 UAE Commercial Companies Law reform, foreigners can now own 100% of a mainland UAE company in the majority of business activities without requiring a local UAE national partner or sponsor. All UAE freezone companies have always permitted 100% foreign ownership. We advise on the optimal business structure and complete the full company formation process.
UAE Golden Visa eligibility categories include property investors with AED 2 million or more in UAE property, entrepreneurs with an established or approved business, skilled professionals in priority sectors earning AED 30,000 or more per month, outstanding university students with GPA 3.75 or above, financial investors with AED 2 million in UAE funds, and recognised humanitarian or creative talent pioneers. We conduct free eligibility assessments.
Trademark registration in UAE is handled by the UAE Ministry of Economy. The process involves a trademark clearance search, application filing, Ministry examination, publication in the Official Trademark Journal for 30 days and final registration. The full process typically takes 6 to 18 months. We manage the complete process on your behalf including responding to any objections or oppositions that arise.
End-of-service gratuity in the UAE is calculated at 21 days basic salary per year for the first five years of service, and 30 days basic salary per year for each year beyond five years. You are entitled to full gratuity whether you resign or are terminated after completing at least one year of service. Gratuity is calculated on basic salary only — not on allowances or commissions.
Yes. Every new client receives a free 30-minute legal consultation with a UAE licensed lawyer. Contact us by WhatsApp on +971 52 568 1836 or by email at info@lawyerszone.ae.
